§ 1 Scope of these Terms and Conditions
The following General Terms and Conditions apply exclusively to the contracts concluded between All About Wine Handels GmbH, - Geisels Weingalerie -, represented by the Managing Director Mr. Stephan Geisel, Schützenstraße 11, 80335 Munich (hereinafter referred to as: Geisels Weingalerie), and the purchaser (hereinafter referred to as: the customer).
§ 2 Conclusion of the Contract
Our product offers on the internet do not represent a binding offer to conclude a purchase contract but rather an invitation to submit an order (purchase offer by the customer). The purchase contract only comes into existence through our explicit order confirmation. Please note that your purchase offer is legally binding. The contract language is German.
§ 3 Order Process
You can currently submit your purchase offer in the following ways: by phone, in writing, or by email. The data you provide will only be used to process and deliver your order and will not be passed on to third parties by us. When placing orders through our online shop, please follow these steps:
3.1. Place a product of your choice in the shopping cart. Review your shopping cart ("View Cart"). You can change the number of bottles using the "+/-" signs and, after entering the desired quantity, update it using the right button "Update". You can continue shopping by clicking the "Continue Shopping" button, or proceed to the next section by clicking the "Checkout" button.
3.2. You have three options for placing your order: a. Log in for registered customers - click the "Log in" button to proceed. b. Order without registration - click the "Continue" button to proceed to the next section. or c. Order and register as a customer - click the "Continue" button to proceed to the next section.
3.3. If you wish to deliver to a different address, you can select this option now.
3.4. Click the "Continue" button to proceed to the next section.
3.5. Now you can select the payment method.
3.6. Review or amend your order. Please take note of our Terms and Conditions, the right of withdrawal, and the privacy policy. Finally, you place your order with the legally binding "Buy" button.
§ 4 Youth Protection
By placing your order with GEISELS WEINGALERIE, you confirm that you are at least 18 years old. The customer is responsible for ensuring that only they or an adult authorized by them receives the delivery. Our logistics partner is entitled to request age verification upon delivery.
§ 5 Prices and Payment Methods
5.1. The prices valid at the time of the customer’s order apply. All prices are final prices, including the statutory VAT and, if applicable, the sparkling wine tax. Additional costs for special deliveries or costs resulting from repeated delivery attempts will be charged to the customer.

5.3. If you have chosen "prepayment" as the payment method, we will reserve the relevant goods for you for a period of 14 days from the date of our pro forma invoice. If payment is not received within this period, the reservation will expire.
§ 6 Shipping Costs & Delivery Area
For orders with a value of less than €99.00, we charge a contribution of €8.90 per package (up to 21 bottles) for packaging and transport within Germany. For orders with a value of more than €99.00, we offer free delivery within Germany. Courier service by arrangement within the S-Bahn area of Munich up to 36 bottles is a flat rate of €25.

§ 7 Delivery
7.1. Deliveries are made according to the shipping conditions valid at the time of the order to the delivery address specified by the customer.
7.2. Delivery is made by parcel service, forwarding agency, or our own delivery vehicle (see delivery area). The standard delivery time is 2-5 working days, with delivery on Saturdays, Sundays, and public holidays excluded.
7.3. If the customer delays acceptance or culpably breaches other duties to cooperate, GEISELS WEINGALERIE is entitled to claim compensation for any damage incurred, including additional expenses. Further claims are expressly reserved. In the event of acceptance delay by the customer, the risk of accidental loss or deterioration of the goods passes to the customer.
7.4. If you are not a consumer, delivery and dispatch are at your own risk.
§ 8 Right of Withdrawal for Consumers

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods. by means of a clear statement (e.g., a letter sent by post, fax, or email) of your decision to withdraw from this contract. You may use the attached model withdrawal form, but it is not obligatory. To meet the withdrawal deadline, it is sufficient for you to send the communication regarding your exercise of the right of withdrawal before the withdrawal period has expired.
Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive standard delivery offered by us), without undue delay and in any event no later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us without undue delay and in any event no later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired. You will have to bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

§ 9 Return Procedures
9.1. Please avoid damage and contamination. Please return the goods in a resalable condition. If possible, use the original packaging for the return. If you no longer have the original packaging, please ensure sufficient protection against transport damage with appropriate packaging.
9.2. Please note that the above paragraph is not a prerequisite for the effective exercise of the right of withdrawal. We strive for a fair relationship with you as our customer, independent of legal obligations.
§ 10 Retention of Title
We retain ownership of the delivered goods until full payment of all claims arising from the delivery contract.
§ 11 Warranty
Statutory warranty rights apply to all products in our shop.
§ 12 Cork Taint
Tartar and sediment are not quality defects and are not grounds for complaint. Cork taint and other significant wine defects will be replaced upon presentation of the wine within a maximum of 2 years after purchase. We cannot provide replacements for wines older than 10 years. We do not replace wines with defects due to improper storage.
§ 13 Jurisdiction
13.1. If the customer is a business, the place of jurisdiction for all disputes arising from contractual relationships between the customer and GEISELS WEINGALERIE is the court responsible for our registered office in Munich.
13.2. Notwithstanding the above, we are in any case entitled to bring an action against our customer at another statutory place of jurisdiction.
13.3. If the customer is a consumer within the meaning of the BGB, the following applies: Actions by GEISELS WEINGALERIE against the consumer must be brought at the consumer’s place of residence according to the statutory jurisdiction pursuant to § 13 ZPO.
§ 14 Notice
The colours of the products depicted on the internet may differ slightly from the original due to various reasons (lighting conditions during the photograph, monitor settings, quality of the graphics card, etc.). Status: October 2020
